Terms of Use

By accessing or using Physly (the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, you may not use the Service. These Terms are a legally binding agreement between you and Luminacode, MB (“Physly”, “we”, “us”, “our”), governing your use of the Physly mobile application and website.

Physly is a mobile application that provides a personalized exercise program for back pain, neck pain and posture. The Service includes a questionnaire-based assessment, Camera Vision range-of-motion measurements, exercise programs, progress tracking and related features.

Physly is a general wellness and exercise application. It is not a medical device, and it does not diagnose, treat, cure or prevent any disease or condition. Measurements, “normal ranges”, severity labels (such as mild, moderate or severe) and exercise suggestions are provided for informational and educational purposes only and are not a substitute for professional medical advice, diagnosis or treatment.

Always consult a physician or licensed physiotherapist before starting any exercise program, and stop immediately and seek medical attention if you experience sharp pain, numbness, tingling, weakness, dizziness or any worsening of symptoms. Never disregard professional medical advice because of something you have read or seen in the Service.

You must be at least 13 years old to use the Service. If you are between 13 and 16 (or the applicable age in your jurisdiction), you must have the consent of a parent or legal guardian.

You may be required to create an account using a third-party sign-in provider (Apple, Google). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We may suspend or terminate your account if we suspect unauthorized use or a breach of these Terms.

Use at your own risk. By using the Service you acknowledge that physical exercise carries inherent risks, that you are solely responsible for assessing your own fitness and health, and that you assume full responsibility for any injury or health issue that may result from using the Service or following any suggested exercise. Physly’s measurements depend on camera placement, lighting and how you perform each test, and may be inaccurate.

Physly offers auto-renewing subscriptions (monthly and annual) purchased through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Any free trial applies to the annual plan and converts to a paid subscription unless cancelled before the trial ends. You can manage or cancel subscriptions in your App Store account settings. Refunds are handled by Apple under its policies. Prices may vary by region and may change; changes apply to future billing periods.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

You agree not to: use the Service for any unlawful purpose; interfere with or disrupt the Service; reverse engineer, decompile or disassemble any part of the Service; copy or redistribute exercise content, videos or measurement methodology; use automated means to access the Service; or use the Service to harm any person.

All content, branding, exercise programs, videos, software and technology in the Service are owned by or licensed to Luminacode, MB and are protected by intellectual property laws. You may not copy, modify or distribute any part of the Service without our prior written permission.

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or for any other reason. You may delete your account at any time in the app or by contacting apps@luminacode.lt.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of measurements, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that it will relieve pain or improve any condition.

To the fullest extent permitted by law, Luminacode, MB shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any personal injury arising from exercise performed in connection with the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

You agree to defend, indemnify and hold harmless Luminacode, MB, its affiliates and service providers from any claims, liabilities, damages, losses and expenses arising from your use of the Service or violation of these Terms.

We may update these Terms from time to time and will update the “Last Updated” date. Continued use after changes means you accept the revised Terms.

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles. Mandatory consumer protection rules of your country of residence are not affected.
